GENERAL TERMS OF SALE

Acceptance of the General Terms of Sale and Conclusion of the Contract

1.1 The contract concluded between CABAN s.r.l. and the Customer (i.e., the individual who makes the purchase on the Site, not related to their commercial, entrepreneurial, or professional activity) is considered concluded with the acceptance, even partial, of the order by CABAN s.r.l. In case of non-acceptance of the order, CABAN s.r.l. will promptly notify the Customer.

1.2 By placing an order in the various ways provided, according to the order form on the Site (hereinafter the “Order“), the Customer declares to have read all the information provided during the purchase procedure and to fully accept these general conditions (hereinafter the “Conditions“).

1.3 These Conditions can be printed or saved on a durable medium, in compliance with the provisions of art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree. 21/2014.

Purchase Methods

2.1 The products offered for sale by CABAN s.r.l. are only those present on the Manuela Conti site at the time of the Order submission, as described in the relevant information sheets.

2.2 It is understood that the images accompanying the product description sheet are for informational purposes only and may not perfectly represent its characteristics but may differ, for example, in color and size (also due to the browser and monitor used to access the Site and view the images).

2.3 To place an Order, the Customer must fill out the relevant form on the Site in its entirety and send it after carefully reviewing the Conditions, as well as the characteristics of the product(s) they intend to purchase. The Customer must also request CABAN s.r.l., if desired, to issue a fiscal invoice for the purchase, pursuant to art. 22 of Presidential Decree No. 633/1972.

2.4 The correct receipt of the Order is confirmed by CABAN s.r.l. via an email response sent to the email address provided by the Customer. This confirmation message will briefly outline the purchase conditions, as required by applicable law, as well as the data entered in the Order by the Customer, so that they can verify them and promptly communicate any necessary corrections of incorrect data.

Prices and Payment Methods

3.1 The prices indicated on the site are inclusive of taxes and VAT. Any shipping costs or payment fees will be communicated to the Customer in advance through the site or these Conditions.

3.2 The following payment methods are available:

(i) PayPal

For payment, the customer can use the PayPal circuit according to its specific methods.

(ii) Credit card

In cases of purchasing goods with the Credit Card payment method, the transaction can occur through the secure PayPal server or another secure server chosen by CABAN s.r.l.

In no case and at no stage of payment will CABAN s.r.l. be able to know the Customer’s credit card information, transmitted via a protected connection directly to the bank’s website managing the transaction. No computer archive of CABAN s.r.l. will store such data, and therefore CABAN s.r.l. cannot be held responsible for any fraudulent or improper use of credit cards by third parties during payment.

Delivery of Products and Related Costs

4.1 The purchased products will be delivered to the address indicated by the Customer in the Order within 24-48 hours from the acceptance of the Order by CABAN s.r.l., at the cost specifically indicated on the Site before the Order is sent. CABAN s.r.l. reserves the right to accept or decline deliveries requested outside Italian or European borders. In any case, for deliveries to be made outside Italian borders, shipping costs and delivery times may vary.

4.2 For deliveries requested in countries not belonging to the European Union, any import customs duties will be borne by the recipient. Therefore, the Customer is invited to contact their country’s customs authorities in advance to verify costs and any import limits.

4.3 The delivery times indicated by CABAN s.r.l. are purely indicative, and a delay in them, or any delivery made with subsequent split shipments, does not entitle the Customer to refuse the delivery itself and to request compensation or indemnities.

4.4 Upon delivery of the products, the Customer is required to check:

  • that the number of packages delivered corresponds to what is indicated in the transport document.
  • that the packaging is intact, not damaged, wet, or otherwise altered, even in the sealing materials (adhesive tape or metal straps).

Any damage to the packaging and/or the product or the mismatch in the number of packages or indications must be immediately reported by placing a specific indication on the product delivery document to be returned to the courier.

Any issues related to the physical integrity, correspondence, or completeness of the products received must be reported within 7 days of delivery, according to the methods provided in this document.

Right of Withdrawal

5.1 Pursuant to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to provide reasons and without any penalty, within 14 (fourteen) working days from the date of receipt of the products.

5.2 To exercise the right of withdrawal referred to in the previous article 5.1, the Customer must send a communication to CABAN s.r.l. to that effect, within the indicated terms, to the following email address servizioclienti@cabansrl.com

5.3 In case of withdrawal, the Customer must return the products to CABAN s.r.l. at their own expense within 14 (fourteen) days from the withdrawal itself, to the following address:

The goods must be returned intact, complete with all its parts, and in the original packaging (bags and boxes), stored and possibly used for the time strictly necessary to establish and verify its nature, characteristics, and size, according to normal diligence, without signs of wear or dirt, in compliance with the conditions set out below:

  • the right of withdrawal may apply to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (e.g., accessories, complements, etc.);
  • for withdrawal to be possible, the product must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: labels, tags, seals, etc.);
  • the shipping costs (and any customs duties, if applicable) for returning the goods will be borne exclusively by the Customer.
  • the shipment, until the certificate of receipt in the warehouse indicated by CABAN s.r.l., is under the complete responsibility of the customer;
  • in case of damage to the goods during transport, CABAN s.r.l. will notify the Customer, to allow them to promptly file a complaint against the courier they chose and obtain the relevant refund; the product will then be made available to the Customer, simultaneously canceling the withdrawal request;
  • CABAN s.r.l. will not be liable in any way for damage, theft, or loss occurring during or in any case in connection with the shipment for the return.

5.4 CABAN s.r.l. will refund the Customer the full amount already paid, net of any additional shipping costs pursuant to art. 56, paragraph 2, of Legislative Decree 21/14), within 14 (fourteen) days from the withdrawal, through the procedure of reversing the charged amount, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed. In any case, the Customer will not incur any costs as a result of said refund. CABAN s.r.l. may suspend the refund until the returned product is received or until the Customer proves that they have correctly returned the product, if earlier.

5.5 In any case, the Customer will lose the right of withdrawal in cases where CABAN s.r.l. ascertains that:

  • the returned product and/or its accessories, and/or its packaging are not intact;
  • the product is missing its external packaging and/or original internal packaging;
  • the product is missing integral elements and/or accessories (e.g., closures, laces, buckles, etc.).

In the event of the loss of the right of withdrawal, CABAN s.r.l. will return the purchased product to the sender, charging them the shipping costs and, if already refunded, the price of the product.

Warranties

6.1 All products sold by CABAN s.r.l. are covered by a 24 (twenty-four) month warranty for conformity defects, pursuant to Title III of Legislative Decree. 206/2005. To benefit from warranty assistance, the Customer must keep the invoice or payment receipt, together with the transport document.

6.2 The warranty for conformity defects will apply provided that the product has been used correctly, in compliance with its intended use and the instructions for use and washing present in and/or with the product.

6.3 In the event that, for any reason, CABAN s.r.l. is unable to return a product under warranty to the Customer (repaired or replaced), or where the repair or replacement is, also due to the value of the product, excessively burdensome, CABAN s.r.l. may proceed with an appropriate reduction of the price paid, or the return of the entire amount paid with the termination of the contract.

6.4 In cases where the application of warranties requires the return of the product, it must be returned by the Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment).

Privacy

8.1 The personal data collected with the submission of the Order will be processed by CABAN s.r.l. solely to fulfill the Customer’s express requests, in compliance with EU Regulation 2016/679 and the privacy policy on the site. Any further processing will be carried out only with the Customer’s express consent.

Applicable Law

9.1 The sales contract referred to in these Conditions and its execution is governed by Italian law, with the exclusion of conflict of law rules and the United Nations Convention on Contracts for the International Sale of Goods. For the resolution of related disputes, the court of the Customer’s place of residence will have jurisdiction.
